Scam alert

Scammers are sending text messages claiming to be from the SCDOR. The SCDOR does not send texts asking for sensitive data. If you get this message, do not reply or click a link. Delete the message from your device and report it as spam.

How to apply

To be eligible, you must have filed a joint return and received either a notice of assessment from the SCDOR or a notice that a tax refund has been applied to a tax debt. You generally have two years from the notice date to submit a Request for Innocent Spouse Relief (SC8857).

You must submit copies of the following documents with your request: 

  • state and federal tax returns
  • W2 forms
  • divorce decree or separation agreement
  • any other supporting documentation that’s applicable, such as court orders and police reports
  • Innocent Spouse Relief documentation from the IRS, if you applied

The SCDOR generally reviews and responds to these requests within 10 business days.
